Usually, not on your own. In Ontario, if the property is a matrimonial home, one spouse generally cannot sell it without the other spouse’s consent or a court order. If the home is jointly owned, a court may order a sale under the Partition Act. If only one spouse is on title, the Family Law Act may still prevent a sale without the other spouse’s consent if it was the matrimonial home. The best first step is usually to understand whether you are dealing with a married-spouse issue, a common-law ownership issue, or a title issue, because the answer often changes based on that.
